Welcome to Abayati.ae. By accessing or using our website, products, and services (the “Services”), you agree to these Terms of Service (“Terms”). If you do not agree, please do not use the Services.

1) About Us

Abayati.ae (“we”, “us”, “our”) is an online abaya store based in the United Arab Emirates (UAE).

2) Eligibility & Account

You must be at least the age of majority in your jurisdiction to purchase.
If you create an account, you’re responsible for safeguarding your login details and all activity under your account.
Provide accurate, complete information and keep it updated.

3) Orders & Acceptance

Your order is an offer to buy. We may accept or reject any order for reasons including stock availability, pricing or product information errors, or suspected fraud.
We’ll confirm acceptance by sending a dispatch/shipping confirmation. If an order cannot be fulfilled, we’ll notify you and (if charged) process a reversal where applicable.

4) Pricing, Currency & Taxes

Prices are displayed in AED unless stated otherwise.
We may change prices at any time before your order is accepted.
International orders may be subject to customs duties, taxes, and clearance fees charged by the destination country; these are the customer’s responsibility.

5) Payment

We accept the payment methods shown at checkout and may use third-party payment processors.
You authorize us and our payment partners to charge the total order amount, including shipping, taxes, and fees.
We do not store full card numbers on our servers.

6) Shipping & Delivery

Processing time: typically 1–2 business days after payment (excluding weekends and UAE public holidays).
Estimated delivery: 4–10 business days after dispatch; in GCC countries (UAE, Saudi Arabia, Kuwait, Qatar, Oman, Bahrain) typically 6–10 business days after dispatch.
Timeframes are estimates and can vary due to customs, courier workload, weather, or remote locations.
Shipping fees are shown at checkout; free-shipping promotions apply only when eligibility conditions are met.
Risk of loss passes to you upon delivery to the address provided or upon collection by you/your agent.

7) Address Accuracy & Delivery Attempts

You are responsible for providing a complete and accurate address and reachable phone number.
Couriers may attempt delivery 1–3 times; failed delivery or incorrect addresses may lead to returns and additional re-delivery charges.

8) Returns, Replacements & Exchanges

No refunds are offered.
If you receive an incorrect or faulty item, contact us within 24–72 hours of delivery with your Order # and clear photos; once verified, we will replace it at no extra cost.
We cannot offer exchanges or adjustments for incorrect measurements provided by the customer—please consult the Size Guide before ordering.
Items must be unused, unwashed, and with all tags for any replacement to be processed.

9) Product Information & Care

We aim to display colors, sizing, and descriptions accurately; however, minor variations may occur due to lighting, screen settings, or production runs.
Many items use premium satin polyester with a non-stretch structure. We recommend professional cleaning.

10) Prohibited Uses

You agree not to misuse the Services, including by:

Violating laws or third-party rights;
Attempting to access non-public areas, disrupt security, or interfere with the site;
Using bots, scrapers, or automated means without our prior written consent;
Posting or transmitting harmful, deceptive, or infringing content.

11) Intellectual Property

All content on Abayati.ae (text, images, logos, graphics, design, and software) is owned by or licensed to us and is protected by applicable laws.
You may not copy, distribute, modify, or create derivative works without our prior written consent.

12) Privacy

Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and protect your data. By using the Services, you consent to those practices.

13) Warranties & Disclaimers

Except as expressly stated, the Services and products are provided “as is” and “as available” without warranties of any kind, express or implied (including merchantability, fitness for a particular purpose, or non-infringement).
We do not guarantee uninterrupted, timely, secure, or error-free operation of the site.

14) Limitation of Liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, loss of profits, data, goodwill, or other intangible losses arising out of or related to your use of the Services or products.
Our total liability for any claim shall not exceed the amount you paid for the product(s) giving rise to the claim.

15) Indemnity

You agree to indemnify and hold Abayati.ae and our affiliates, officers, employees, and partners harmless from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from your breach of these Terms or misuse of the Services.

16) Force Majeure

We are not responsible for delays or failures caused by events beyond our reasonable control, including acts of God, natural disasters, war, terrorism, labor disputes, government actions, pandemics, or failures of suppliers or carriers.

17) Suspension or Termination

We may suspend or terminate your access to the Services at any time if we believe you violated these Terms or applicable laws, or for operational/security reasons. You may stop using the Services at any time.

18) Governing Law & Dispute Resolution

These Terms are governed by the laws of the United Arab Emirates (without regard to conflict of laws).
Any dispute shall be subject to the exclusive jurisdiction of the courts of the UAE.
Before filing a claim, both parties will attempt to resolve the dispute informally by contacting support@abayati.ae.

19) Changes to the Services or Terms

We may update the Services and these Terms from time to time. Updates take effect when posted on this page with the “Last updated” date above. Your continued use of the Services after changes are posted constitutes acceptance of the updated Terms.
